Terms of Service

1. Acceptance of Terms

By accessing or using Enshrine ("App" or "Service"), operated by 1st Grade Dynamics ("Company," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms are a legally binding agreement between you and 1st Grade Dynamics. We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.

2. Eligibility

  • You must be at least 18 years old to use the Service.
  • By registering, you represent that you are 18 or older and legally able to enter into binding contracts.
  • We may use age-verification measures and may suspend or terminate accounts that do not meet eligibility requirements.
  • We use a third-party identity-verification provider (Didit) to capture a brief liveness selfie at signup and during periodic re-verification. If your account is suspended for violating our Community Guidelines, we retain the opaque Didit session identifier tied to your suspended account for up to one (1) year to prevent you from creating a new account with the same face ("ban-evasion"). See our Privacy Policy for details.
  • The Service is not available where prohibited by law.

2A. Account Suspension and Appeals

  • We may suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms or our Community Guidelines.
  • When your account is suspended, you will be signed out, blocked from re-registering with the same email, and — for one (1) year — prevented from registering a new account that our liveness provider matches to the face used on the suspended account.
  • You may appeal a suspension once per incident using the link provided in your suspension email or in the in-app suspension notice. Appeals are reviewed by a human moderator, typically within seven (7) days.
  • If your appeal is approved, your account will be fully restored and the ban-evasion identifier associated with it will be deleted.
  • If your appeal is denied, the suspension stands. Repeated appeals for the same incident will not be reviewed.

3. Account Registration

  • You must provide accurate, complete, and current information.
  • You are responsible for safeguarding your login credentials.
  • You are responsible for all activity under your account.
  • You must promptly notify us at [email protected] of unauthorized use.
  • One account per person unless we expressly permit otherwise.

4. User Conduct

You agree not to:

  • Post false, misleading, fraudulent, or deceptive content.
  • Harass, threaten, stalk, or harm others.
  • Use the Service for spam, commercial solicitation, or unauthorized advertising.
  • Upload illegal, obscene, defamatory, or rights-infringing content.
  • Impersonate any person or entity.
  • Circumvent or interfere with security or platform integrity.
  • Use bots, scrapers, or automation without written permission.
  • Solicit money or financial information from users.
  • Share content depicting minors in a sexual context.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of content you submit ("User Content"). By submitting User Content, you grant 1st Grade Dynamics a worldwide, royalty-free, sublicensable, non-exclusive license to host, use, reproduce, adapt, distribute, and display that content to operate, maintain, and improve the Service.

5.2 Our Content

All trademarks, logos, software, and Service content are owned by 1st Grade Dynamics or its licensors. You may not copy, distribute, modify, or create derivative works from our content except as permitted by law or written permission.

5.3 Photo and Video Content

  • You may upload only content you own or are authorized to share.
  • We may remove content that violates these Terms or https://yoxihbfrmlayqbphotfj.supabase.co/storage/v1/object/public/legal/policies/community-guidelines.html.
  • Nudity and explicit sexual content are prohibited unless specifically permitted in a designated, age-gated feature.

6. AI-Based Matching

  • The Service may use automated systems and AI to suggest matches.
  • Suggestions are not guarantees of compatibility, behavior, or safety.
  • Automated outputs may be imperfect.
  • Where required by law, you may request human review of significant automated decisions. See our Privacy Policy for how to request review.

7. Location Services

  • The Service may request location access for proximity-based features.
  • Location data may be used to show nearby users and improve relevance.
  • You can disable location permissions in device settings, but features may be limited.
  • We do not sell precise real-time location data.

8. In-App Purchases and Subscriptions

  • The Service may offer paid features, subscriptions, and virtual goods ("Premium Features").
  • Charges, billing cycles, and renewal terms are shown at purchase.
  • Subscriptions renew automatically unless canceled at least 24 hours before renewal (or as required by app-store rules).
  • You manage or cancel subscriptions through your app-store account settings.
  • Prices may change with notice as required by law.
  • Virtual goods have no cash value and are non-transferable unless required by law.

9. Live Video and Chat

  • Live features may be moderated for safety and compliance.
  • Prohibited behavior includes nudity, harassment, and illegal acts.

  • We may end sessions or restrict access for violations.

10. Safety and Reporting

  • Use in-app tools to report abusive, suspicious, or harmful behavior.
  • We review reports and may act at our discretion.
  • We are not responsible for user conduct but may enforce these Terms.
  • In emergencies, contact local emergency services.

11. Termination

We may suspend, restrict, or terminate accounts, with or without notice, including for:

  • Suspected fraud, abuse, or unlawful activity.
  • Security or risk concerns.

You may delete your account through in-app settings where available. Upon termination, your right to use the Service ends immediately.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UPTIME, AVAILABILITY, OR ERROR-FREE OPERATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1st Grade Dynamics WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Regional Availability

Enshrine is offered only in the United States and Canada. You may not use the Service outside these countries. We may block, restrict, or terminate access from other regions.

15. Canadian Users

If you are a Canadian resident, your personal information is handled under PIPEDA and any applicable provincial privacy law. See Section 11 of our Privacy Policy for your rights and how to exercise them, including how to file a complaint with the Office of the Privacy Commissioner of Canada.

Nothing in these Terms limits any non-waivable consumer rights you have under Canadian federal or provincial law.

16. California Residents

California residents have additional rights under the CCPA/CPRA. See our Privacy Policy and California Privacy Policy.

17. Governing Law and Dispute Resolution

  • Governing law: Washington, United States (without regard to conflict-of-law principles, where applicable).
  • Primary dispute forum: State or federal courts located in Benton County, Washington.
  • If arbitration is selected by mutual written agreement, arbitration rules/administrator: American Arbitration Association (AAA), Commercial Arbitration Rules.
  • If arbitration is selected, arbitration venue: Benton County, Washington.
  • If arbitration is not selected, court venue: Benton County, Washington.
  • Class-action waiver (if permitted): disputes must be brought individually, not as a class or representative action.
  • If required by law, you may also seek relief in small claims court or from local consumer authorities.
  • Canadian users retain any rights they have under provincial consumer-protection legislation to pursue disputes in their home province.
